Terms of service

These terms apply when you use joshuaperets.com (the "site") or buy from Joshua Perets ("Joshua Perets", "we", "us") online. By using the site or placing an order, you agree to these terms and to our Privacy Policy, Shipping Policy and Refund Policy, which are part of these terms. Nothing in these terms limits rights you have under the Quebec Consumer Protection Act or any other law that can't be waived.

Who can use the site

The site is intended for people in Canada. If you are under the age of majority where you live, use the site with the involvement of a parent or guardian. Children under 14 should not use the site or give us personal information without the consent and supervision of a parent or guardian.

When you place an order, you confirm that you are of the age of majority, or that you are a minor able to make the purchase on your own for your ordinary and usual needs, and that you are authorized to use the payment method you provide.

Your account

Keep your login details private. You are responsible for activity on your account. Tell us right away at hi@joshuaperets.com if you think someone else is using it.

Products and prices

We try to show our products, colours and sizes accurately, but colours may look different on your screen. Prices are in Canadian dollars and don't include taxes or shipping, which are shown at checkout. Products are subject to availability, and we may limit quantities.

If a product is listed at the wrong price, or with other wrong information, we will contact you before shipping and let you choose to buy it at the correct price or cancel your order. If we can't reach you within 10 days, your order will be cancelled and you won't be charged for it.

Orders and payment

Your order is an offer to buy. The order confirmation email confirms that we received it. We accept your order when we ship it and send you a shipping confirmation. We authorize your payment when you order and charge it when your order ships.

We may refuse or cancel an order, including after payment, if a product is unavailable, if there is a pricing error, or if we have reason to believe the order is fraudulent or misuses our policies, including attempts to get around payment or to exploit promotions to receive items for free. If we cancel, you get a full refund to your original payment method.

Accurate information

Please give us accurate, complete information, including your shipping address. If a package is returned to us because the address was wrong or incomplete, we'll contact you. We can reship it once you pay the shipping cost again, or refund your order minus the original shipping cost.

Electronic communications

You agree to receive order confirmations, shipping notices and other information about your orders and account by email or on our site. These count as written notice. They are separate from marketing messages, which you receive only if you subscribed.

Shipping and delivery

We ship within Canada. Delivery times and costs are in our Shipping Policy. Delivery times are estimates. Ownership and risk of loss pass to you when your order is delivered.

Carriers may leave a package at your address without a signature (a "safe drop"). Safe drops are decided by the carrier, and we are not responsible for a package lost or damaged after one. Please follow your tracking closely, arrange for someone to receive the package, and pick it up promptly once it is delivered. For special delivery instructions, contact us before you place your order.

Returns and exchanges

Returns, exchanges and refunds follow our Refund Policy.

Promotions, gift cards and store credit

Promotions and promo codes have their own conditions, shown with the offer. Unless they say otherwise, they can't be combined, have no cash value, and can be changed or ended at any time without affecting orders already placed.

When we run contests or giveaways, each one has its own official rules.

Gift cards don't expire and have no fees. They can't be exchanged for cash, except where the law requires it. Treat a gift card like cash: we can't replace one that is lost or stolen.

Store credit is attached to your Joshua Perets account and can be used online or in our stores. It can't be exchanged for cash.

Our content

Everything on the site, including our name, logos, designs, photos and text, belongs to Joshua Perets or our licensors. You may use the site for your own personal shopping. You may not copy, reproduce or use our content for commercial purposes without our written permission.

Your submissions

If you send us comments, ideas, reviews, photos or other content, you confirm that you have the right to share it, and you allow us to use, reproduce and publish it in connection with our business, without payment. We won't publish your full name without your permission.

Acceptable use

Don't use the site to break the law, interfere with the site or its security, scrape or harvest data, place orders for resale or with false information, or misuse our promotions.

Third-party services and links

Some services on our site are provided by others, such as Shop Pay, PayPal and other payment options, and carrier tracking. They have their own terms and privacy policies. Our site also links to other sites and social networks that we don't control, and we're not responsible for their content or practices.

Ending access

We may suspend or end your access to the site or your account, without notice, if you break these terms, commit fraud or misuse our promotions. If you're a consumer in Quebec, we will tell you why. Sections that by their nature should continue, such as those on liability and governing law, still apply after access ends.

Mobile Terms of Service

The Joshua Perets mobile message service (the "Service") is operated by Joshua Perets (“Joshua Perets”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Joshua Perets’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Joshua Perets through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Joshua Perets. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +1 (833) 611-2371 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Joshua Perets mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

We respect your right to privacy. To see how we collect and use your personal information, please see our Privacy Notice.

Liability

We provide the site as it is and do our best to keep it accurate and available, but we can't promise it will always be error-free or uninterrupted. To the extent the law allows, Joshua Perets is not liable for indirect or consequential damages arising from your use of the site. Our products come with the legal warranties provided by the Quebec Consumer Protection Act, and nothing in these terms excludes them or our liability for our own acts or those of our representatives.

Events outside our control

We're not responsible for delays or failures caused by events we can't reasonably control, such as carrier delays, severe weather, strikes, power or internet outages, or public health measures.

Governing law and disputes

These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. If you are a consumer, you may bring a claim before the courts of your place of residence. If you have a concern, please contact us first at hi@joshuaperets.com so we can try to resolve it informally. This doesn't limit your right to go to court.

Other terms

If a court finds part of these terms invalid, the rest still applies. If we don't enforce a part of these terms right away, we can still enforce it later. These terms, together with the policies they refer to, are the full agreement between you and us about the site and your online purchases.

Language

These terms are available in French and English. You can switch languages using the language selector on our site.

Changes to these terms

We may update these terms. The version that applies to your order is the one posted when you placed it. When we make important changes, we change the date at the top of this page and give at least 30 days' notice on our site or by email before they take effect.
